6 What are the consequences of death?
In the event of death, the rules in sections 2.3, 5.1 and 5.2 apply as regards the inventory and the distribution and allocation of debts and assets, except that the share of property that the deceased would have received will now go to his/her heirs. There may be compensation, and the surviving spouse is entitled to survivor’s usufruct rights (usufructo viudal), which can vary in amount according to whether the surviving spouse inherits together with the deceased’s descendants or ascendants or is the sole inheritor. The rights are primarily assigned in property but may also be assigned in cash (Art. 834-840 CC). The share of property covered by usufruct rights can be increased (up to the legal limit) in a will.
